Terms of Use
The rules of this site, explained.
These terms set out what you can expect from this site and what we expect from anyone using it. They are short to read because they describe only what the site does: present Arquely, the two initial offerings and the interest list.
1. Who operates this site
This site is operated by Arquely, the working name of the team incorporating the legal entity that will operate the site and the products. The contact for everything relating to these terms is contact@arquely.com.
The company name, registered office and tax number will be published on this page and in the legal notice immediately after the entity's registration is complete.
2. Purpose of these terms
These terms govern use of the site: visiting pages, reading content, submitting the interest form and the associated technical features (language, form draft). They do not govern services: when there is an automation or document services contract, the Service Conditions and the signed contract apply.
These terms sit alongside the Privacy Policy, the Cookie Policy, the Legal Notice and the Accessibility Statement, all published on this site. Where documents conflict, the most specific document for the matter at hand prevails.
3. Acceptance
By using the site, you are taken to have read and accepted these terms. If you disagree with any part, you should stop using the site. Acceptance requires no formal step: it results from ordinary use, as is standard for informational websites.
The applicable version is always the one published at the time of your visit, identified by the effective date at the top of the page.
4. Definitions
- Site — the public pages served at arquely.com and domains that redirect there.
- User — anyone visiting the site, whether or not they submit the form.
- Content — texts, images, emblem, code, visual layout and other site elements.
- Interest list — the set of contacts who asked to hear about the products, managed for that purpose alone.
- Offerings — the two initial services: Arquely Business Automation (process automation) and Arquely Document Intelligence (document reading with OCR and AI).
- Service Conditions — the document published on this site governing service contracts.
5. Description of the site
The site is institutional. It presents the company, what is being built, the two initial offerings and a way to get in touch — the interest form. There is no shop, no payment processing, no user accounts and no visitor uploads.
The product pages describe each offering in detail: who it is for, how it works, what it does not do and how it is contracted. That description is informational; the terms of any project are set out in the proposal and the contract.
6. Launch phase and the nature of the information
Arquely is launching its first products. At this stage, nothing on the site constitutes a binding offer, a contract or a promise of availability: descriptions may change, plans may be adjusted and dates mentioned in conversations create no obligations until a written proposal is accepted.
Prices are not published as numbers because they depend on each case's volume and integration; establishing them concretely is part of the initial conversation. Any figure is binding only when it appears in a proposal accepted in writing.
7. Permitted use
- Reading, browsing and sharing links to the site's pages.
- Submitting the interest form with truthful information about yourself.
- Quoting excerpts of the content with clear attribution to Arquely and a link to the source page.
- Using screen readers, translation tools and other assistive technology.
- Keeping copies of pages for personal, non-commercial use, provided ownership notices remain intact.
8. Prohibited conduct
- Copying, reproducing or redistributing the content, in whole or in part, for commercial purposes without written permission.
- Using robots, scrapers or automated processes to collect, index or reproduce the site beyond the normal operation of search engines.
- Using the site's content to train or fine-tune automated systems, language models or databases without written permission.
- Testing, probing or bypassing the site's security measures without written permission; responsible disclosure of vulnerabilities is welcome by email, without exploitation.
- Overloading the infrastructure, introducing malicious code or attempting to access systems, data or restricted areas.
- Submitting the form with third-party data without authorisation, false information, spam, or for purposes unrelated to the interest list.
- Impersonating Arquely, the team or other users, including in email.
- Removing ownership notices, trademarks or origin markings from the content.
- Using the site for unlawful activities or in breach of third-party rights.
9. The interest form
The form exists for one thing: letting people who have a process to automate or documents to process reach us and join the interest list. It is voluntary and creates no contractual relationship by itself, no reservation of capacity and no price commitment.
Use an email you control and a comment that helps us reply — for example, the process or the kind of documents. Submission is confirmed on the site itself and handled under the Privacy Policy. You can ask to be removed from the list at any time by writing to contact@arquely.com.
Arquely may close the list or stop responding to submissions that breach these terms, without prior notice.
10. Prices and contracting
Nothing on the site constitutes a price offer or an invitation to immediate contracting. Services are contracted through a written proposal accepted by the interested company and are governed by the Service Conditions published on this site.
References to pricing models (monthly fee per company, document volume or integration project) describe the format, not figures.
11. Intellectual property
Everything you see on the site — texts, emblem, visual identity, code, page structures and the way the whole is organised — belongs to Arquely or is used with permission, and is protected by copyright and related rights law and by industrial property law.
Visiting the site grants you a limited, personal, non-exclusive licence to view the content and use the features, under section 7. It grants no other rights: copying, modifying, distributing, publishing, selling, sublicensing or commercially exploiting the content requires prior written permission.
Quotation for information, comment or criticism is permitted by law, provided it is brief, attributed and not misleadingly edited. To reuse anything beyond that, write to contact@arquely.com: we always reply.
12. Trademarks and product names
Arquely, Arquely Business Automation and Arquely Document Intelligence are distinctive signs used by Arquely to identify the company and the offerings. Registration will follow its own steps once the entity is incorporated.
Nothing on the site grants a licence to use those signs. Nominative references — identifying Arquely or the offerings in a truthful, informative context — are permitted; use as your own mark, or in a way suggesting sponsorship or partnership, requires written permission.
13. Links to other sites
The site currently includes no links to third-party websites beyond textual references to entities and laws. If external links are added, they will be marked as such and provided for convenience: Arquely does not control those sites and is not responsible for their content, practices or policies.
14. Availability, changes and discontinuation
We work to keep the site available and correct, but we do not guarantee uninterrupted operation: maintenance, provider failures, network problems or events beyond our control can happen. Where possible, relevant changes are announced in advance.
Arquely may change, replace or discontinue pages, sections or features without giving rise to any compensation for use of the site, which is free.
15. Accuracy of information and no warranties
The information on the site is written with care and reviewed periodically, but it is informational and general: it describes what we do today and is not legal, tax, accounting or financial advice. Before deciding based on it, confirm the concrete terms with us or with your advisers.
The site is provided as is, without warranties beyond those that law mandatorily imposes.
16. User responsibility
Each user is responsible for their use of the site: for the truthfulness of the information they submit, for the rights over any content they send and for the consequences of conduct contrary to these terms or the law.
If you use the site on behalf of a company, you confirm you are authorised to do so; the company and the user answer jointly and severally as the law provides.
17. Limitation of liability
Arquely is liable for direct damage it causes through negligence in operating the site, under the general rules of law. It is not liable for indirect damage — such as lost profits, lost opportunity or lost data — arising from use of, or inability to use, a free informational website, to the maximum extent permitted by law.
Nothing in this clause excludes or limits liabilities mandatorily imposed by Portuguese or Mozambican law, and nothing affects consumer rights where consumer law applies to the case.
18. Indemnity
To the extent permitted by law, the user indemnifies Arquely against third-party claims arising from use of the site contrary to these terms, including prohibited conduct, false information submitted in the form or infringement of intellectual property rights.
19. Privacy and cookies
Personal data processing is described in the Privacy Policy; browser storage is described in the Cookie Policy. Both documents form part of the regime for using the site as much as these terms do.
20. Electronic communications
Communications about the site and the interest list are sent by email, to the address you provided or to contact@arquely.com. They are deemed received on the next business day after sending, unless delivery failure is proven.
We communicate in Portuguese and English; if you prefer one language, say so and we respect the preference.
21. Changes to these terms
These terms may be revised when the site, the law or Arquely's practice changes. The version in force is always published on this page, with the effective date at the top. Material changes are flagged on the page and, where possible, communicated to those on the interest list.
Using the site after a new version is published means accepting that version; anyone who disagrees should stop using the site.
22. Suspension and termination of access
Arquely may suspend or block access to the site, without prior notice, for conduct that breaches these terms, compromises the site's security or availability, or is required by law or by a competent authority.
Termination of access does not affect obligations already incurred, nor clauses that by their nature must survive.
23. General provisions
- Severability: if a clause is held invalid, the rest remain in force and the invalid clause is replaced by the one that best matches its purpose.
- No waiver: failing to exercise a right is not a waiver of it; one-off tolerance creates no acquired right.
- Entire agreement: these terms, with the documents referred to in section 2, are the complete agreement on use of the site.
- Assignment: the user may not assign their rights or obligations without Arquely's written consent; Arquely may assign them in a reorganisation or succession, preserving users' rights.
24. Applicable law and jurisdiction
These terms are governed by Portuguese law. Where the user is protected by mandatory consumer law in their country of residence, that law prevails to that extent.
For consumer disputes, the court of the consumer's place of residence has jurisdiction; for all other situations, the Portuguese courts, without prejudice to mandatory law applicable in Mozambique where a case must be tried there.
25. Alternative dispute resolution
In a consumer dispute, the consumer may turn to the registered alternative dispute resolution entities (the official list is published on the Consumer Portal, www.consumidor.gov.pt). Arquely prefers to resolve matters directly first: write to us and we propose a solution within 15 business days.
Arquely is not obliged to take part in consumer arbitration beyond the cases the law imposes; where it does, it treats the decision as binding.
26. Contact
